These Terms of Service ("Terms") govern access to and use of Charger Reserve, a room and resource scheduling application operated by Bullitt East High School ("School," "we," "us," or "our"). By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility and Access
Charger Reserve is available only to individuals authorized by the School (typically employees, contractors, and designated administrators). Accounts are provisioned through the School's authentication process. You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
2. Purpose of the Service
Charger Reserve allows authorized users to browse school resources, submit booking requests, approve or deny reservations, and manage facility schedules. Features may include instant booking, approval workflows, recurring or multi-date requests, notifications, calendar integration, and administrative reporting. We may modify features at any time.
3. Bookings and Approvals
Submitting a booking request does not guarantee approval. Approvers may approve, deny, or request changes according to School policies and resource availability. You agree to provide accurate event details and to comply with setup, teardown, capacity, and usage rules for each resource.
Confirmed bookings may be cancelled by you, an approver, or an administrator subject to School policy. Cancelling individual dates within a multi-date request does not automatically cancel other dates in the same request unless you choose to cancel all remaining dates.
4. Acceptable Use
You agree not to:
- Use the service for unlawful, unauthorized, or non-school-related purposes
- Attempt to access data or accounts belonging to others without permission
- Interfere with or disrupt the service, including circumventing security controls
- Upload malicious files or content that violates law or School policy
- Misrepresent your identity, role, or affiliation with the School
- Use automated means to scrape or overload the system without authorization
Use of school facilities remains subject to Bullitt County Public Schools policies, building use rules, and applicable laws.
5. Intellectual Property
The Charger Reserve application, branding, and related materials are owned by the School or its licensors. You receive a limited, non-exclusive, non-transferable license to use the service for authorized School purposes. You retain ownership of content you submit, but grant the School a license to use that content as needed to operate scheduling, approvals, and notifications.
6. Third-Party Services
The service may integrate with third-party providers (including authentication, hosting, email, and calendar services). Your use of those integrations may be subject to separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
7. Disclaimer of Warranties
CHARGER RESERVE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SCHEDULING CONFLICTS IN ALL CASES.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SCHOOL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE MINIMUM AMOUNT PERMITTED BY LAW, WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify and hold harmless the School from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the service, violation of these Terms, or violation of applicable law or School policy, except to the extent caused by our gross negligence or willful misconduct.
10. Suspension and Termination
We may suspend or terminate access at any time for violation of these Terms, security concerns, or when your authorization to use School systems ends. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination will survive.
11. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date indicates the current version. Material changes may be communicated through the application or School channels. Continued use after changes become effective constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Disputes shall be resolved in the courts located in Bullitt County, Kentucky, unless applicable School or district dispute procedures apply.
